Terms and Conditions

These Terms and Conditions ("Terms") constitute a legal agreement between you and Eresteo LTD ("Eresteo," "Company," "we," "us," or "our") concerning your access to and use of our mobile applications, websites, digital content, and related services that link to these Terms (collectively, the "Services").

Please read these Terms carefully before using a Service. By accessing or using a Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By accessing or using a Service, you confirm that:

  • You have the legal capacity required under applicable law to enter into these Terms;
  • If you are a minor or otherwise require authorization from a parent or legal guardian under applicable law, that authorization has been obtained before you use the Service;
  • If you use a Service on behalf of a minor or another person for whom you are legally responsible, you have the authority required by applicable law to do so;
  • You will comply with these Terms and all applicable laws and regulations; and
  • Information you provide to us will be accurate and complete to the best of your knowledge.

2. About the Services

Eresteo LTD develops and provides mobile applications, websites, digital content, and related services. Features and functionality may differ between Services.

Certain Services may include, for example, account functionality, subscriptions, connected-user features, location sharing, family-safety features, emergency or SOS functionality, user-generated content, notifications, or other digital features.

Unless otherwise stated for a specific Service, the Services are intended primarily for personal, non-commercial use.

We may update, change, suspend, or discontinue features or Services. Where a material change affects a paid Service or your legal rights, we will provide notice where required by applicable law and will respect any mandatory consumer rights that apply.

3. Accounts

3.1 Creating an Account

Certain Services may require you to create an account. If you create an account, you agree to:

  • Provide accurate, current, and complete information;
  • Maintain and update your account information where appropriate;
  • Keep your login credentials secure and confidential;
  • Not knowingly allow unauthorized access to your account; and
  • Use the account only in accordance with these Terms.

3.2 Account Security

You are responsible for taking reasonable steps to protect your account and credentials.

If you become aware of unauthorized access or suspected misuse of your account, contact us promptly at support@eresteo.com.

To the extent permitted by applicable law, Eresteo LTD is not responsible for losses caused solely by your failure to protect credentials or by unauthorized activity outside our reasonable control. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

3.3 Suspension and Termination

We may suspend, restrict, or terminate an account or access to a Service where reasonably necessary, including if:

  • You materially breach these Terms;
  • You engage in fraudulent, abusive, harmful, or illegal activity;
  • Your use creates a security risk or threatens other users, Eresteo LTD, or third parties;
  • Suspension or termination is required by law, a court order, or a platform provider; or
  • We discontinue the relevant Service.

Where reasonably possible and legally appropriate, we may provide notice before suspension or termination.

Termination or suspension does not affect rights and obligations that by their nature should survive termination, including intellectual-property rights, accrued payment obligations, legal claims, and applicable limitations of liability.

4. Subscriptions, Purchases, and Payments

4.1 Paid Features and Subscription Plans

Certain Services may offer subscriptions, paid features, or other purchases.

The applicable price, billing period, included features, trial terms, renewal terms, and other purchase information will be shown before you complete the purchase.

4.2 Free Trials and Promotional Periods

We may offer free trials or promotional periods.

Where a trial automatically converts to a paid subscription, the duration of the trial and the applicable renewal terms will be disclosed before you subscribe.

You are responsible for cancelling before the end of the trial if you do not want the subscription to convert to a paid plan, subject to the cancellation rules of the applicable payment platform and applicable law.

4.3 Billing and Automatic Renewal

Subscriptions may automatically renew at the end of each billing period unless cancelled in accordance with the rules of the payment platform through which the subscription was purchased.

Payment may be charged by Google Play, the Apple App Store, or another authorized payment provider.

The billing period and renewal price will be displayed before purchase.

If a subscription price changes, notice will be provided as required by the applicable payment platform and applicable law.

4.4 Cancellation

You may cancel a subscription through the store, payment provider, or account-management method through which it was purchased.

Unless otherwise required by applicable law or the applicable payment platform, cancellation generally stops future renewals and access to paid features continues until the end of the current paid billing period.

Deleting an Eresteo account does not necessarily cancel a subscription managed by an external app store or payment provider. Where necessary, you must separately cancel the subscription through that provider.

4.5 Refunds and Consumer Rights

Refunds, cancellations, withdrawals, subscription management, and payment disputes may be subject to the rules of the applicable app store or payment provider as well as applicable law.

Nothing in these Terms limits any refund, cancellation, withdrawal, conformity, repair, price-reduction, termination, reimbursement, or other consumer right that cannot lawfully be excluded or restricted.

Where permitted by the relevant platform, Eresteo LTD may assist with or issue refunds in accordance with applicable platform rules and law.

4.6 Payment Processing

Payments may be processed by third-party payment providers such as Google Play, the Apple App Store, or another authorized provider.

We may receive transaction-related information necessary to administer your purchase or subscription, but we do not receive or store full payment-card details when the payment is handled entirely by the third-party provider.

Your purchase may also be subject to the terms and policies of the applicable payment provider.

5. User Conduct

When using a Service, you agree not to:

  • Violate applicable laws, regulations, or third-party rights;
  • Use a Service to stalk, harass, threaten, intimidate, abuse, exploit, or harm another person;
  • Track, monitor, or collect information about another person without any consent, authorization, or other legal basis required by applicable law;
  • Impersonate another person or entity;
  • Provide materially false, deceptive, or misleading information;
  • Interfere with, damage, overload, disable, or disrupt a Service or its infrastructure;
  • Attempt to gain unauthorized access to accounts, systems, networks, or data;
  • Use bots, scraping tools, automated systems, or scripts in a manner not expressly authorized by us;
  • Circumvent security, access-control, subscription, or technical restrictions;
  • Upload, transmit, or distribute malware, malicious code, or harmful material;
  • Reverse engineer, decompile, disassemble, or attempt to derive source code except to the extent such restriction is prohibited by applicable law;
  • Copy, modify, distribute, sell, sublicense, or create derivative works from the Services except as expressly permitted by us or by applicable law;
  • Remove or alter copyright, trademark, or other proprietary notices; or
  • Use a Service for an unlawful or unauthorized purpose.

6. Location, Safety, and Connected-User Features

Certain Services may provide location-sharing, family-safety, connected-user, emergency, SOS, geofence, territory, or similar functionality.

If you use such features, you acknowledge that:

  • Location information may be collected and, depending on the feature and your settings, shared with users you connect with or authorize;
  • Location accuracy and availability depend on device hardware, permissions, connectivity, operating-system behavior, satellite availability, environmental conditions, and other factors outside our control;
  • Location or safety information may be delayed, incomplete, unavailable, or inaccurate;
  • You are responsible for obtaining any consent, authorization, or legal basis required before tracking, monitoring, adding, or sharing information about another person;
  • You must not use the Services for stalking, coercive control, harassment, unlawful surveillance, or other abusive conduct;
  • Location, SOS, notification, or safety features are supplementary tools and should not be treated as the sole means of protecting a person or responding to an emergency; and
  • In an emergency, you should contact the appropriate local emergency services where available.

To the fullest extent permitted by law, Eresteo LTD is not responsible for decisions made solely in reliance on location, device-status, notification, or other safety-related information where that information is delayed, unavailable, or inaccurate due to factors outside our reasonable control.

7. Intellectual Property

7.1 Our Rights

The Services and their software, code, interfaces, text, graphics, logos, icons, images, audio, video, designs, databases, trademarks, and other materials are owned by Eresteo LTD or its licensors and are protected by applicable intellectual-property laws.

Except for rights expressly granted under these Terms, no rights are transferred to you.

7.2 Limited License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the relevant Service for its intended purpose.

Unless expressly authorized, this license does not permit you to:

  • Sell, rent, sublicense, or commercially exploit the Service;
  • Copy or distribute substantial parts of the Service;
  • Modify or create derivative works from the Service;
  • Circumvent technical restrictions; or
  • Reverse engineer the Service except where applicable law expressly permits it.

7.3 User Content

You retain ownership of content you submit or upload to a Service to the extent you own that content.

By submitting content, you grant Eresteo LTD a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use that content only to the extent reasonably necessary to:

  • Operate and provide the Service;
  • Enable features you choose to use;
  • Maintain, secure, troubleshoot, and improve the Service;
  • Comply with applicable law; and
  • Enforce these Terms.

This license ends when the relevant content is deleted from our systems, except where continued retention is technically necessary for a limited backup period or legally required.

You represent that you have the rights and permissions necessary to submit any content you provide.

7.4 Feedback

If you voluntarily provide suggestions, ideas, or feedback regarding a Service, you grant us permission to use that feedback without restriction or compensation, provided that doing so does not give us ownership of your separate pre-existing intellectual property.

8. Third-Party Services

A Service may integrate with or link to third-party products or services, including app stores, authentication providers, payment processors, map providers, cloud services, analytics services, or other platforms.

Third-party services are governed by their own terms, privacy policies, and practices.

We do not control independent third-party services and, to the extent permitted by law, are not responsible for their content, availability, security, accuracy, or practices.

Your use of a third-party service may require you to accept separate terms with that provider.

9. Availability, Updates, and Changes to Services

We may release updates, bug fixes, patches, security updates, or new versions of a Service.

Certain updates may be required for continued use, security, compatibility, or proper functionality.

We do not guarantee that every Service or feature will always be available, uninterrupted, or compatible with every device or operating-system version.

Where we materially modify or discontinue a paid digital Service, we will comply with applicable law and any mandatory consumer remedies or notice requirements.

10. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

We do not guarantee that:

  • A Service will always be uninterrupted, error-free, or available;
  • Every defect will be corrected immediately;
  • A Service will be compatible with every device, operating system, network, or third-party service;
  • Location, device-status, safety, or other data will always be accurate, complete, or current; or
  • A Service will meet every individual expectation or requirement.

However, nothing in these Terms excludes or limits any warranty, guarantee, conformity obligation, statutory remedy, or other consumer right that cannot lawfully be excluded or limited under applicable law.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Eresteo LTD and its directors, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services.

To the fullest extent permitted by law, this may include loss of profits, business opportunities, goodwill, or data.

Where applicable law permits a contractual cap on liability, Eresteo LTD's aggregate liability arising out of or relating to a Service or these Terms will not exceed the greater of:

  • The amount you paid to Eresteo LTD for the relevant Service during the 12 months preceding the event giving rise to the claim; or
  • EUR 50.

These limitations do not apply where liability cannot lawfully be excluded or limited, including where applicable law provides otherwise for fraud, intentional misconduct, gross negligence, death or personal injury, statutory consumer rights, or other mandatory liabilities.

12. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Eresteo LTD and its directors, officers, employees, contractors, and agents from third-party claims, losses, liabilities, damages, and reasonable costs arising directly from:

  • Your unlawful use of a Service;
  • Your material breach of these Terms;
  • Your infringement of a third party's rights; or
  • Content you submit where you did not have the right to provide it.

This section does not require you to indemnify Eresteo LTD for losses caused by our own unlawful conduct, negligence, or breach of obligations that cannot lawfully be excluded.

13. Privacy

Our Privacy Policy explains how we collect, use, share, retain, and protect Personal Data in connection with the Services.

The Privacy Policy forms part of the information governing your use of the Services but does not replace any separate consent or authorization required by applicable law.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in:

  • The Services or their features;
  • Applicable law or regulation;
  • Security or technical requirements;
  • Payment or platform requirements; or
  • Our business operations.

When we make changes, we will update the "Last updated" date.

Where changes are material, we may provide additional notice through the Service, by email, on our website, or by another reasonable method.

Where applicable law requires your express agreement to a contractual change, we will request it separately.

If you do not agree to revised Terms, you may stop using the affected Service and, where applicable, exercise any cancellation or termination rights available under law or the relevant payment platform.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Cyprus, without prejudice to any mandatory consumer-protection rights you may have under the laws of the country in which you habitually reside.

Nothing in these Terms deprives a consumer of the protection of mandatory provisions of applicable law that cannot be excluded by contract.

Subject to applicable mandatory jurisdiction rules, disputes arising out of or relating to these Terms or the Services may be submitted to the competent courts of Cyprus.

If you are a consumer, you may also have the right to bring proceedings before courts or use dispute-resolution mechanisms available to you under mandatory laws applicable in your country of residence.

Before initiating formal legal proceedings, you are encouraged, but not required where prohibited by law, to contact us at support@eresteo.com so that we can attempt to resolve the matter.

16. General Provisions

16.1 Entire Agreement

These Terms, together with any additional product-specific terms that expressly apply to a Service and any documents incorporated by reference, constitute the agreement between you and Eresteo LTD regarding your use of that Service.

16.2 Product-Specific Terms

Certain Services may include additional terms, rules, purchase conditions, community standards, or feature-specific conditions.

If product-specific terms conflict with these Terms, the product-specific terms control only with respect to the relevant Service or feature, unless applicable law requires otherwise.

16.3 Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

16.4 Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

16.5 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where applicable law gives you a non-waivable right to do so.

We may assign or transfer these Terms as part of a merger, acquisition, corporate reorganization, sale of assets, or similar transaction, or to an affiliate or successor, subject to applicable law and without reducing mandatory consumer rights.

16.6 No Third-Party Beneficiaries

Unless expressly stated otherwise, these Terms do not create rights for any person or entity other than you and Eresteo LTD.

16.7 Electronic Communications

Where permitted by law, notices and communications relating to a Service may be provided electronically, including through the Service, by email, or through our website.
